These Terms of Service ("Terms") govern your use of cadencewise.com (the "Site") and the client-management and automation services offered by Cadencewise LLC ("Cadence Wise," "we," "us," or "our"). We are a women-owned, Texas-based business serving service businesses across the United States remotely. By accessing our Site or engaging our services, you agree to these Terms.

Use of Our Site

Our Services and No Guarantee of Results
Cadence Wise provides client-management, lead-response, scheduling, follow-up, and related automation services. Our services are modular and may be purchased individually or as a bundle. Every business and market is different, and we do not guarantee any specific outcome, level of leads, bookings, revenue, or return on investment. Results depend on factors outside our control, including your business, market, and how our recommendations are implemented.
SMS Text Message Consent
By providing your mobile number and consenting where prompted, you agree that we may send SMS text messages, including appointment reminders and booking confirmations, lead follow-up replies, account and service-update notifications, and marketing messages, offers, or newsletters when you have opted in. Message frequency varies. Standard message and data rates may apply. Consent is not a condition of using our Site.
You may opt out of SMS at any time by replying STOP to any message, or by contacting us. For help, reply HELP. We will not sell or share your mobile number or SMS consent for third-party marketing.
Fees and Payment
Fees for paid services are described on our pricing page or in your service agreement. Unless stated otherwise, fees are due in advance, in US dollars, and are non-refundable except as required by law or as expressly stated in writing. We may change fees with reasonable notice; changes do not affect fees already paid.
Your Responsibilities
You agree to:
- Provide accurate and current information when requesting services
- Obtain proper consent before sharing any contact's information with us
- Comply with all applicable laws, including those governing marketing and SMS
- Use any tools, accounts, or credentials you provide to us in a lawful manner
Intellectual Property
The Site, our branding, and original content are the property of Cadencewise LLC and are protected by intellectual property laws. Content you provide remains yours; by sharing it with us for the purpose of delivering services, you grant us a license to use it as needed to perform that work.
Third-Party Tools and Services
Our services may involve or connect with tools and platforms operated by third parties. We are not responsible for the availability, accuracy, or practices of third-party services, and your use of them is subject to their own terms and policies.
Limitation of Liability
To the fullest extent permitted by law, Cadencewise LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of revenue, profits, data, or business opportunity, arising from your use of our Site or services. Our total liability for any claim is limited to the amount you paid us for the service giving rise to the claim in the twelve months before it arose.
Indemnification
You agree to indemnify and hold harmless Cadencewise LLC and its members and contractors from claims arising from your use of our Site or services, your breach of these Terms, or your violation of any law or third-party right.
Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or our services will be resolved in the state or federal courts located in Travis County, Texas, and you consent to that venue.
Changes to These Terms
We may update these Terms from time to time. We will post the new version here and update the "Last updated" date. Your continued use after changes take effect means you accept the updated Terms.
